What is an Affidavit of Heirship?

An Affidavit of Heirship is an affidavit that can be used in certain situations to identify the heirs of a deceased property owner and transfer their interest to their heirs. The affidavit is generally used when a property owner either dies without a will or a property owner’s will was not probated within four years of their death.

What information does a Affidavit of Heirship contain?

The affidavit contains a statement of facts about the family history, genealogy, marital status, and identity of the heirs of the deceased property owner. The affidavit is then filed in the property records in the county where the property is located.
